Changes in the RDE –IED Registry: Re – establishment of mandatory submission of periodic information and automatic registration of operations

On December 7, 2016 the Brazilian Central Bank (“BACEN”) published its Rule No. 3.814, implementing changes to BACEN’s Rule No. 3.689/2013, which regulates the provisions on foreign capital in Brazil and on Brazilian capital abroad, to determine, among other changes: (i) the re-establishment of the mandatory submission of periodic information to BACEN by the Brazilian companies receiving foreign direct investment; and (ii) the automatic registration in the RDE-IED Module of certain operations.

Considering that the Circular nº 3.814/16 will enter into force on January 30, 2017, in principle and except if otherwise indicated by BACEN, Brazilian companies receiving foreign direct investment are obliged to submit until January 31, 2017 the periodic statement for the reference date of December 31, 2016.
